Act CVIII of 2001 on Electronic Commerce Services and Certain Issues of Information Society Services;
Act V of 2013 on the Civil Code (HCC);
Government Decree 151/2003 (IX. 22.) on the mandatory warranty for certain durable consumer goods;
Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses;
NGM Decree 19/2014 (IV. 29.) on the procedural rules for handling warranty and guarantee claims related to goods sold under a contract between a consumer and a business
3. Scope of the GTC, amendment of the GTC
In addition to the mandatorily applicable legal provisions, these GTC apply to the contract concluded between you and the Seller. The Seller is entitled to amend the provisions of these GTC within the framework of applicable law. Please read the provisions of the GTC before each purchase! Any amendment to the GTC becomes effective from the date of publication on the website. Changes do not affect contracts already concluded up to that point (confirmed orders).
3.1. Acceptance of the GTC
Before finalizing your order, you are obliged to familiarize yourself with the provisions of these GTC. By making a purchase through the www.fejesfarm.hu website, you accept the provisions of these GTC, and the GTC form an integral part of the contract concluded between you and the Seller.
3.2. Language of the contract
The language of contracts governed by these GTC is Hungarian.
3.3. Information on the form of the contract
Contracts governed by these GTC do not qualify as written contracts; the Seller does not file them, and after performance it does not store contract-related data. We recommend that you keep the data confirming your purchase for any potential future enforcement of claims.
3.4. Prices
Prices are indicated in Hungarian Forints and include 0% VAT. Prices are for information purposes; we reserve the right to change prices.
4. Additional consumer information
You qualify as a consumer if, as a private individual (natural person), you purchase from the Seller outside the scope of your profession, independent occupation, or business activity. Information on consumer rights is available by clicking this link.
5. Complaint handling, legal remedies
5.1. Handling of complaints

In the event of a consumer complaint, the Seller shall endeavor to carry out repair or replacement within a maximum of fifteen days. If the consumer does not agree with the handling of the complaint, or if investigation of the complaint is not possible, the Seller shall immediately draw up minutes of the complaint and its position regarding it, and provide or send a copy to the consumer by e-mail.
5.2. Other legal remedies
If any consumer dispute between the Seller and the consumer cannot be settled through negotiations, the following legal remedies are available to the consumer:

Turning to a conciliation board. For the out-of-court, amicable settlement of consumer disputes relating to the quality and safety of products and the application of product liability rules, as well as the conclusion and performance of contracts, the consumer may initiate proceedings before the conciliation board operating alongside the professional chamber competent according to the Seller’s registered office. The Seller cooperates with the Board during the procedure. For the purposes of applying the conciliation board rules, a consumer also includes a civil organization, church, condominium association, housing cooperative, micro-, small- and medium-sized enterprise as defined by a separate act, which purchases, orders, receives, uses or utilizes goods, or is the addressee of commercial communication or an offer related to the goods.

Online dispute resolution platform. The European Commission has created a website where consumers can register and thus have the opportunity to resolve disputes related to online purchases by completing an application, avoiding court proceedings. In this way, consumers can enforce their rights even if, for example, distance would prevent them from doing so. If you wish to make a complaint about a product or service purchased online and do not necessarily want to go to court, you can use the online dispute resolution tool. On the portal, you and the trader against whom you have lodged a complaint can jointly select the dispute resolution body to be entrusted with handling the complaint. Court proceedings. The consumer is entitled to enforce claims arising from a consumer dispute before a court in civil proceedings pursuant to Act V of 2013 on the Civil Code and Act CXXX of 2016 on the Code of Civil Procedure.
In consumer protection administrative authority cases, the consumer protection inspectorates of the capital city and county government offices act as first-instance authorities with county-level competence. Jurisdiction may be established by the consumer’s place of residence, the business’s registered office, premises, and the place where the infringement was committed. The application may be submitted to any competent inspectorate.

7. Copyright
Pursuant to Section 1(1) of Act LXXVI of 1999 on Copyright (hereinafter: “Copyright Act”), the website qualifies as a copyrighted work, and therefore all parts of it are protected by copyright. Based on Section 16(1) of the Copyright Act, it is prohibited to use any graphical and software solutions, computer program works, or any application that enables modification of the website or any part thereof without authorization. Any material from the website and its database may be taken over—even with the written consent of Fejes Farm Ltd.—only with a reference to the website and by indicating the source.
8. Miscellaneous
If any clause of the GTC is legally incomplete or invalid, the remaining clauses of the contract remain in force, and the applicable provisions shall replace the invalid or defective part.
The Seller has no code of conduct under the act on the prohibition of unfair commercial practices vis-à-vis consumers.
9. Operation of digital content, technical protection measures
The availability of the service providers’ servers storing the data displayed on the website exceeds 99.9% per year. The data content is stored on servers on multiple hard drives using RAID technology. If any hard drive is damaged, the system remains operational with the remaining hard drives. Full backups of the entire data content are made regularly, so in the event of a problem the original data content can be restored.
10. Compatibility of digital content with hardware and software
The data displayed on the website is stored in a MySQL database. Sensitive data is stored with encryption of appropriate strength; for its encoding we use hardware support built into the processor.
11. Information on using the website
11.1. Information on the essential characteristics of the products
On the website, we provide information on the essential characteristics of products available for purchase in the product data sheets and product descriptions available for each product. The information on the product page is for informational purposes only! Images may be illustrations, and colors may not always correspond to reality!
11.2. Correction of data entry errors – responsibility for the accuracy of the provided data
During the ordering process, prior to finalizing the order, you have the opportunity to modify the data you entered. Please note that you are responsible for ensuring that the data you provide is entered accurately, as invoicing and delivery are carried out based on the data you provide. By placing your order, you acknowledge that the Seller is entitled to pass on to you any and all damages and costs arising from your incorrect data entry or inaccurate data. The Seller excludes liability for performance based on inaccurate data entry. Please note that an incorrectly provided e-mail address or a full mailbox may result in the non-delivery of the confirmation and may prevent the conclusion of the contract.
11.3. Procedure in case of an incorrect price
It may occur that an incorrect—e.g., due to a typographical error—price is displayed on the website. In the case of an offer made at an incorrect price, no contract is concluded between us. If you make an offer at an incorrect price, the system automatically confirms it, but this does not constitute acceptance of the offer by us. In the event that you make an offer (place an order) at an incorrect price, during the electronic (non-automatic) confirmation sent by the Seller’s colleague, the Seller’s colleague will draw your attention to the correct price and may offer to conclude the contract at the correct price. You are not obliged to make an offer or conclude a contract at the correct price communicated by the Seller instead of the incorrect price. In this case, no contract is concluded between the parties.
12. Ordering process
You do not need to register to use the website or to make a purchase. For more convenient shopping, we recommend registering, because then you will not have to re-enter your details during your next purchase.
The information published on the website does not constitute an offer by the Seller to conclude a contract. For orders governed by these GTC, you qualify as the offeror, and the contract is concluded by the Seller’s acceptance of the offer made by you via the website, in accordance with the provisions of these GTC.
12.1. Selecting the Product
By clicking on the product categories on the website you can select the desired products. By clicking on individual products you will find the product photo, item number, description, price and dimensions. In the event of purchase, you must pay the price displayed on the website. Products are marked with illustrative photos.
12.2. Adding to cart
After selecting a Product, you can add any number of products to the cart by clicking the “Add to cart” button without incurring any purchase or payment obligation, because adding to the cart does not constitute an offer.
We recommend that you add the product to the cart even if you are not sure you want to purchase it, because this allows you to review at a glance which products you have selected at that moment and to view and compare them on one screen. The contents of the cart can be freely modified until the order is finalized; products can be removed, additional products can be added, and the desired quantity can be changed.
If you do not wish to select more products, click the “Cart” button at the top of the website, then click “Proceed to checkout”.
12.3. Viewing the cart
While using the website, you can check the contents of your cart at any time by clicking the “Cart” icon at the top of the website. Here you can remove selected products from the cart and change the quantity.
If you do not wish to select and add further products to the cart, you can continue the purchase by clicking the “Proceed to checkout” button.
12.4. Entering buyer details
After clicking the “Proceed to checkout” button, you can continue the purchase by entering your delivery details. You can then select the desired payment and delivery method.
12.5. Reviewing the order
As the last step of the purchase, before finalizing your order, you can review your order. Here you will see a summary of the data you previously provided, including the contents of the cart, your user, billing and delivery details, and the amount payable by you. In the text box at the bottom of the page you may optionally provide additional information.
13. Finalizing the order (making an offer)
If you are satisfied that the contents of the cart correspond to the products you wish to order and that your details are correct, you can finalize your order (make your offer) by clicking the “Purchase” button. By clicking the “Purchase” button, you expressly acknowledge that your offer is deemed to have been made, and your statement—if confirmed by the Seller in accordance with these GTC—entails a payment obligation.
14. Processing the order
Orders are processed continuously. You have the option to place an order at any time. You will receive an automatic acknowledgement of your order as per Section 14.1. If the order is placed after working hours, it will be processed on the next working day. Your offer binds you for a period of only 48 hours if the Seller does not confirm it in accordance with Section 14.1 of these General Terms and Conditions.
14.1. Automatic confirmation e-mail, conclusion of the contract
After placing your order, you will receive an e-mail notification from the Seller to the e-mail address you provided. The acknowledgement is an automatic e-mail that records the fact that your order has arrived through the website, and this confirmation constitutes acceptance of your offer. If you notice that the automatic confirmation e-mail contains your details incorrectly (e.g., name, delivery address, phone number, etc.), you are obliged to notify us immediately by e-mail while providing the correct details. If you do not receive the automatic confirmation e-mail within 24 hours of placing your order, please contact us, as it is possible that your order did not reach our system due to technical reasons.
It may occur that the product you selected is not available in our warehouse; actual performance time depends on stock levels. However, you will be informed of this and you may indicate whether it is acceptable to you. If you cannot accept the delivery deadline and you notify the Seller by e-mail within 48 hours from the arrival of the Seller’s e-mail in your mailbox, the contract will not be concluded, and you will have no payment obligation and the Seller will have no delivery obligation.
15. Payment method and conditions
15.1. Total amount of your payment obligations
The order summary and the confirmation e-mail under Section 14.1 include all costs payable by you.
15.2. Payment methods
In our webshop, payment is possible by bank transfer in advance and by cash on delivery. In the case of payment by transfer, at the time of placing the order the Buyer must transfer the price of the ordered product(s) as well as the delivery fee to the following bank account number: OTP Bank 11733254-20000404. In the case of cash on delivery, the Buyer shall pay the price of the ordered product(s) and the delivery fee upon receipt. In the case of cash on delivery, an additional fee of HUF 200 is charged to the Buyer.
16. Receipt of the ordered product – delivery methods
16.1. MPL home delivery with cash on delivery
Under this delivery method, the ordered products are delivered by the Hungarian Post (Magyar Posta); deliveries may take place on working days between 8:00 and 17:00. Delivery takes place on the next working day following dispatch. The fee for this delivery method, including the HUF 200 cash-on-delivery fee: HUF 1,810
16.2. MPL home delivery with bank transfer
Under this delivery method, the ordered products are delivered by the Hungarian Post (Magyar Posta); deliveries may take place on working days between 8:00 and 17:00. Delivery takes place on the next working day following dispatch. The fee for this delivery method: HUF 1,590
16.3. MPL “poste restante” parcel pickup with cash on delivery
Under this delivery method, you may specify at which post office you wish to pick up your parcel during the post office’s opening hours. Delivery takes place on the next working day following dispatch. The fee for this delivery method, including the HUF 200 cash-on-delivery fee: HUF 1,710
If the Buyer does not pick up the parcel by the fifth working day following its arrival at the selected post office and it is returned to us, the delivery fee shall be borne by the Buyer. In this case, reshipping will take place only after advance transfer of the price of the ordered product(s).
16.4. FOXpost parcel locker with cash on delivery
Under this delivery method, you may specify from which FOXpost locker you wish to pick up your parcel. Delivery takes place within 1–3 working days following dispatch. The fee for this delivery method, including the HUF 200 cash-on-delivery fee: HUF 1,340

16.6. Permitted delivery address
The delivery address for products may only be an address located within the borders of Hungary. If you request delivery outside Hungary, please contact us to arrange it personally (in this case the delivery fees stated above do not apply; they are applicable only for delivery addresses in Hungary)!
16.7. Presumption of authorization to receive
The Seller shall consider the person entrusted with receipt of the product to be your representative designated for this purpose, who is authorized not only to receive the product but also to make legal statements related to the handover and receipt.
17. Procedure for quality and quantity complaints
You are obliged, at the time of handover and receipt, to make any quality or quantity complaints that are detectable by visual inspection upon receipt, and to compare the received product with the items listed on the invoice and report any discrepancies.
If possible, please inspect the parcel in the presence of the courier upon delivery and, if you notice any damage, request that a report be drawn up.

18. Performance deadline
The general performance deadline for orders is no later than 10 working days from confirmation of the order and/or—if the Seller exercises this right—from the crediting of the advance payment to the Seller’s bank account. This delivery deadline is for information purposes; any deviation will be indicated by e-mail in each case. By accepting these General Terms and Conditions, you acknowledge that the Seller expressly excludes liability for damages due to exceeding the stated delivery time.
19. Reservation of rights
It may occur that the distribution of certain products shown on our website has been discontinued. Therefore, we reserve the right to reject already confirmed orders in part or in full. Partial performance may take place only after consultation with you. If the product price has been paid in advance, the amount will be refunded to you within 14 working days.
